S.S. Said I can’t be approved because I went back to work, I guess you have to quit or get fired to be approved. The system is broken and makes no sense to me it’s my own money but I have to hire an attorney.

@Katontherock My mother should be on disability because of her RA. It is really bad and she is in the same situation kind of as you... she makes too much to go on disability, but she really does not make that much. She does not even work in her career anymore because she is unable to because of her hands... she can no longer use her hands for fine movements, etc. that was required of her in her career/specialty.
She went from making around $100,000 a year in her speciality to about $30,000 now. She does not work in her field anymore... she cleans the offices that she used to work in the medical field because shehas great difficulty using her hands for the fine movements that were required while she worked in the medical field.
However, she basically has to stop working in order to get disability her attorney said and told her that because she tells the doctors when she goes that she is doing ok that that also hurts her case. The attorney said she has to complain (even though that is not her personality - she is very strong). She has to tell the doctors that she feels in pain and it hurts.
However, if she stops working or even works less to be below the income requirment, she would have to loose her house because she would not be able to make payments.
It is a crazy system. Her hands are so bad and it takes her like 6 hours to clean an office because of her pain and dificulty... she is doing all she can. Crazy. The health system.

Alot of the decision is based on all your medical records, job reports, etc. An attorney will gather all the info to present your case to the Judge. In WV, you do have to be off work x6 months, then apply by paperwork & be denied at least 2x before an attorney will accept your case. BUT you can go for a free consultation & the Disability Attorney will advise you they think your case is appropriate. It sure is a broken system & takes too long IF you get approved! :((

Are you able to work any... like make any income at all beyond disability once your case was approved? Or is there restrictions in WV on that also?

I believe according to Fed Laws I am allowed to make some money but I never checked into it for sure. I do know IF you make over that specific amount, they will deduct from your Disability.

I really believe it all comes down to getting in front of the Fed Judge face to face with you & Attorney providing the facts. That ton of paperwork really doesn’t do much~it’s the ability of the Judge to listen to your story & decide whether you truly are not able to work or not. Don’t be afraid of consulting a Disability Attorney~They will help you! Best Wishes!

Thank you @Twiggi for all the information! I agree... we need to get in front of the judge so they can see us and hear us and put a face to the person.
@Magmil84 I have not heard back from you. Would you like some attorney information for some in Florida. I know some not too far from where you live.

two months ago I went into the Social Security office and filled out a ton of paperwork to apply for disability. Within a month of doing that I received a letter in the mail explaining that Crohn’s disease should not prevent me from being able to hold a job down. Every job I’ve had I’ve lost due to too many absences, surgeries and emergency room visits. Has anyone successfully gotten on disability and if so did you use a lawyer?
